Terms of Service

Terms governing use of the Maxna AI website and platform.

By accessing maxna.ai or using Maxna AI services, you agree to these Terms. If you are entering into an order form, subscription agreement, or master services agreement with Maxna, that agreement controls for paid services to the extent of any conflict with these Terms.

Who these terms cover

These Terms apply to visitors of the public website and, except where superseded by a customer agreement, to users of Maxna's sample integrity platform. If you use Maxna on behalf of a company, you represent that you have authority to bind that company.

Website use

You may browse public pages for lawful business purposes. You may not:

  • Scrape, crawl, or harvest the site in a way that overloads or abuses systems
  • Attempt to gain unauthorized access to non-public systems, accounts, or data
  • Interfere with security, authentication, or availability of the site
  • Use the site to transmit malware, spam, or unlawful content
  • Misrepresent your identity or affiliation when contacting Maxna

Services

Maxna provides sample integrity and fraud-detection technology for market research. Customer use of the product - including screening thresholds, integrations, support, and commercial terms - is governed by the applicable subscription agreement, acceptable use rules, documentation, and any order form.

Maxna does not sell sample or respondent panels. Customers remain responsible for their own sample sources, survey content, incentives, and compliance with research and privacy laws applicable to their projects.

Accounts and access

Customer users must keep credentials confidential and notify Maxna promptly of suspected unauthorized access. You are responsible for activity under your accounts. We may suspend access to protect the platform, other customers, or to address suspected abuse or non-payment as described in your customer agreement.

Acceptable use of the platform

When using Maxna services, you may not:

  • Use the product for unlawful surveillance or purposes unrelated to research quality
  • Attempt to reverse engineer, bypass, or undermine fraud-detection controls
  • Probe Maxna systems except through authorized security review processes
  • Resell or white-label the service without written permission
  • Submit unlawful, infringing, or deceptive content through forms or support channels

Intellectual property

Maxna AI branding, software, models, documentation, and website content are owned by Maxna or its licensors. You receive no rights except those expressly granted in a customer agreement or a limited license to view public website content. Feedback you provide may be used by Maxna to improve products without obligation to you.

Customer data and confidentiality

As between Maxna and the customer, the customer retains rights in customer project data as defined in the customer agreement. Maxna treats non-public customer information as confidential and uses it to provide and improve the service, subject to that agreement and our Privacy Policy.

Third-party services

The website or product may link to or integrate with third-party tools (for example survey platforms or sample routers). Maxna is not responsible for third-party services you choose to use. Your use of those services is governed by their terms.

Disclaimers

The website is provided "as is" and "as available." Marketing content does not constitute a warranty. Fraud detection reduces risk but cannot guarantee that all bad actors are blocked or that all good respondents pass. Thresholds, false positives, and false negatives depend on configuration, traffic mix, and evolving attack patterns.

To the fullest extent permitted by law, Maxna disclaims implied warranties of merchantability, fitness for a particular purpose, and non-infringement for website use. Paid service warranties, if any, are solely those stated in your customer agreement.

Limitation of liability

To the fullest extent permitted by law, Maxna is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, or business interruption, arising from website use - even if advised of the possibility of such damages.

Maxna's aggregate liability arising from website use is limited to one hundred U.S. dollars (US $100). Paid service liability caps and exclusions are as stated in your customer agreement.

Indemnity

You agree to indemnify and hold harmless Maxna and its officers, directors, employees, and agents from claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your misuse of the website, your violation of these Terms, or your violation of applicable law - except to the extent caused by Maxna's willful misconduct.

Suspension and termination

We may suspend or terminate website access for violations of these Terms or for security reasons. Customer subscription termination and data return/deletion are governed by the customer agreement.

Governing law and disputes

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law rules, except where mandatory local consumer or privacy law applies. Courts located in Delaware shall have exclusive jurisdiction over disputes arising from website use, unless your customer agreement specifies a different venue or arbitration process for paid services.

Changes

We may update these Terms from time to time. The "Last updated" date will change when we do. Continued use of the website after changes become effective constitutes acceptance of the updated Terms. Material changes to paid services will be handled as described in your customer agreement.
